Pichi Pacha products are for laboratory research purposes only and may not be used for any other purpose, including but not limited to in vivo diagnostic purposes, in food for humans or animals, medicines, medical equipment or cosmetic use, for commercial purposes or for the production of illegal drugs.
None of the products are Pichi Pacha. It is not intended by the manufacturer for human use or consumption. The chemical, physical, and toxicological properties of these chemicals have not been thoroughly investigated. The buyer confirms that he acknowledges that the products have been tested by Pichi Pacha for their safety and efficacy in food, medicines, medical devices, cosmetics, commercial, or other applications.
The Buyer expressly declares and warrants to the company Pichi Pacha that it will test, use, produce, and sell any product purchased from Pichi Pacha, and/or materials made from products purchased from Pichi Pacha, duly in accordance with the practices of an expert in the field and with strict compliance with all applicable laws and regulations, now and hereafter established. The Buyer also warrants to Pichi Pacha that none of the materials sold by Pichi Pacha will be counterfeit or falsely branded products and will not contain prohibited materials.
It is the responsibility of the Buyer to verify the risks and, if necessary, conduct additional research to ascertain the risks associated with the use of the products purchased from Pichi Pacha. The Buyer is also obliged to inform the Buyer’s customers and any supporting staff about all risks associated with the use or handling of the product. The Buyer agrees to follow Pichi Pacha’s instructions regarding the use of the products and undertakes not to use them improperly.
If the buyer of products purchased at Pichi Pacha intends to repackage, relabel, or use the product as ingredients in other products, the buyer must verify the product tests. Unless otherwise stated, any product purchased at Pichi Pacha cannot be considered food, medicines, medical devices, or cosmetics.
Moreover, every customer of Pichi Pacha is obliged to assume full responsibility for every purchase (made now and in the future) of a product or service from Pichi Pacha.
INTERNATIONAL USE
Pichi Pacha does not guarantee that the products offered can be legally purchased outside the Netherlands. The purchase of the offered products may be illegal in some countries. If you are a buyer outside the Netherlands, you do so at your own risk and are responsible for the legality of your jurisdiction. The internal substantive law of the Netherlands applies to these General Terms and Conditions, regardless of conflicting legal principles. Jurisdiction for any claim under this contract rests exclusively with the courts of the Netherlands. If any provision of these Regulations is declared invalid by a competent court, the invalidity of this provision shall not affect the validity of the remaining provisions of these Regulations, which shall remain in full force and effect. No waiver of any condition of these terms shall be deemed a further or continuing waiver of such or any other condition.

MAINTAINING A NON-DAMAGE CONTRACT
The customer declares to acknowledge that: the purchased chemicals and/or materials may have hazardous properties; and that you have a legal right to receive these materials. In exchange for the sale of the offered chemicals and/or supplies to the undersigned, the buyer agrees to the following:
Pichi Pacha makes no guarantee, express or implied, that the chemicals and/or materials are marketable or fit for a particular purpose.
In no event shall Pichi Pacha nor its successors in title be liable for damages, nor shall Pichi Pacha be held liable for any claim for damages arising from or related to the sale, supply, or use of the chemicals and/or supplies exceeding the purchase price of the chemicals and/or consumables.
The buyer shall not use chemicals and/or consumables that violate local, state, or federal laws.
The original client, successors in title, and assignees undertake to protect Pichi Pacha against damage caused by the use of chemical products and/or consumables.
Pichi Pacha guarantees that its products will conform to the description of said products provided by Pichi Pacha to the buyer via the Pichi Pacha catalog, analytical data, or other literature.
The warranties made by Pichi Pacha in connection with this sale shall not be effective if Pichi Pacha determines, at its sole discretion, that the purchaser has misused the products, has not used them in accordance with industry standards and practices, or has not used the products in accordance with Pichi Pacha’s instructions.
The above general terms and conditions apply equally to all current, past, and future purchases. This disclaimer applies to all damage or injury caused by a malfunction or failure of performance, error, omission, interruption, removal, defect, delay in operation or transmission, computer virus, force majeure, failure in the communication line, theft or destruction or unauthorized access, alteration, or use of documentation, whether as a result of breach of contract, negligence, or any other cause.
You agree to defend and protect Pichi Pacha, its officers, directors, employees, and agents against any claim, action, or solicitation, including, but not limited to, reasonable legal and accounting fees, asserted or arising out of or from your use of the Products or your breach of these terms.
